1. Acceptance of Terms

By creating an account, accessing the 2nd Summit platform, or clicking "Accept," you agree to these Terms of Service. If you do not agree, please do not use the platform.

2. Description of Service

2nd Summit provides a platform that aggregates and curates activities, events, products, and community experiences intended to support social, physical, and mental wellness. We may modify, suspend or discontinue any part of the platform at any time without prior notice.

3. Eligibility

You must be at least 18 years old and capable of entering a binding agreement. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4. User Conduct

You agree not to:

  • Misuse the platform or use it for any unlawful purpose.
  • Harass, threaten, or harm other users.
  • Post misleading, defamatory, or unlawful content.
  • Attempt unauthorized access to any part of the platform.
  • Interfere with or disrupt platform operations.

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, without prior notice and without liability to you.

5. User Content

By posting or submitting content to the platform (such as reviews, photos, or comments), you grant 2nd Summit a non-exclusive, royalty-free, worldwide license to use, display, reproduce and distribute that content in connection with operating and promoting the platform. You represent that you own or have the necessary rights to any content you submit.

6. Events and Third-Party Services

Events, services or products listed on the platform may be provided by third parties. 2nd Summit acts as a curator and directory, not as the organizer or provider of those third-party offerings. We do not control these providers and are not responsible for their services, quality, safety, cancellations, or transactions. Any disputes related to a third-party event or service are between you and that provider.

7. Assumption of Risk

Participation in physical, outdoor or wellness-related activities involves inherent risks, including the risk of injury or illness. By using the platform to find or register for such activities, you acknowledge those risks and accept full responsibility for your own health, safety and fitness to participate. You voluntarily assume all risks associated with your participation.

8. Payments, Subscriptions, and Refunds

Some features or events may require payment or a subscription. All prices are listed on the platform and may change with reasonable notice. Payments are processed through third-party payment providers, and your use of those providers is subject to their terms. Refund and cancellation policies for events are set by the applicable event organizer. For 2nd Summit subscription fees, refund requests will be handled on a case-by-case basis by contacting info@2ndsummit.org.

9. Intellectual Property

All platform content, including logos, design, text, and software, is owned by 2nd Summit or its licensors and may not be copied, modified, or distributed without our prior written permission.

10. Disclaimer of Warranties

The platform and all content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, 2nd Summit and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the platform or participation in any activities discovered through it. Our total liability for any claim arising under these Terms will not exceed $100.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms will first be submitted to good-faith informal negotiation by contacting info@2ndsummit.org. If the dispute is not resolved within thirty (30) days, either party may initiate binding arbitration administered under the rules of the American Arbitration Association in Denver, Colorado. Each party will bear its own costs and attorneys' fees unless the arbitrator determines otherwise. You agree that any claims will be brought in your individual capacity and not as part of any class or representative action.

13. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on the platform with a revised "Last Updated" date. Your continued use of the platform after changes are posted constitutes your acceptance of the updated Terms.
